International Crimes Division of the High Court has adjourned indefinitely the trial over the 2017 murder of former police spokesperson Andrew Felix Kaweesi after one of the accused, Yusuf Mugerwa, was reportedly abducted by unknown security operatives and could not be produced before court.
During proceedings, the court heard that Mugerwa was allegedly taken from his workplace in Kasangati, Wakiso District, by individuals believed to be security operatives and transported to an unknown location.
The alleged disappearance prompted concerns from the defence, which informed the court that Mugerwa’s whereabouts remained unknown, making it impossible for the trial to proceed.
In his ruling, Justice Michael Elubu Okalany said the circumstances surrounding Mugerwa made it impractical to fix another hearing date.
“The circumstances regarding Mugerwa do not make it practical to adjourn the case to another hearing date. The case is, therefore, adjourned sine die,” Justice Okalany ruled.
An adjournment sine die means the case has been postponed without a specified date for resumption.
Kaweesi murder case has been before the courts for several years following the fatal shooting of Andrew Felix Kaweesi, his bodyguard Kenneth Erau and driver Godfrey Wambewo in Kulambiro, Kampala, on March 17, 2017.
Multiple suspects have been charged in connection with the killings, with proceedings taking place before the International Crimes Division of the High Court.
The alleged abduction of Mugerwa introduces a new complication in the long-running trial and is expected to raise further questions about the availability of accused persons during criminal proceedings.
